California AG Seeks Dismissal of Lawsuit Over $1.08 Billion Powerball Jackpot

The California Attorney General’s Office is asking a judge to dismiss a lawsuit filed by Stacy Tru, who claims she is entitled to the $1.08 billion Powerball jackpot from the July 19, 2023, drawing. Tru sued the California State Lottery Commission, alleging breach of contract.

In court papers filed on Thursday with Los Angeles Superior Court Judge Upinder S. Kalra, the Attorney General’s Office argues that Tru’s lawsuit should be dismissed because she failed to provide a copy of the contract she claims was breached. The office states that Tru did not include the contract or provide its terms, making her breach of contract claim invalid.

According to California Lottery rules, only a valid, original Powerball ticket can be used to prove a player’s numbers and claim a prize. The Attorney General’s Office emphasized this in its filing, adding that Tru’s case lacks the necessary evidence.

Tru also included a claim for common count, but the Attorney General’s Office argues that both of her claims are flawed and cannot be supported. Filed on January 28, Tru’s lawsuit provides few details, but she is seeking the $1.08 billion jackpot along with interest dating back to October 15, 2023, the date she claims to have first made a request for the prize. The hearing is scheduled for August 21.
